General Sale’s and Shipments Terms

1. The listed prices are free delivered to our customer’s address providing the value of the order is greater than its minimum amount set forth in paragraph 3. This condition does not apply for order to be shipped to the Canary Islands.

2. Orders to be shipped to the Canary Islands would be considered free delivered to the shipping agent and/or forwarder’s agency address duly appointed by the customer and located within the Valencian Community.

3. The minimum order’s value is set forth by Country of destination as follows: Spain: 290 €. – Portugal: 500 €. – France: 600 €/ Other EU countries: Ex-factory terms shall apply.

4. Orders placed which value is under the minimum set amounts shall be are subject to a transport contribution fee which shall be included in the invoice. This fee varies depending on the Country of destination as follows: Spain 24 €. – Portugal 75 €. – France: 139 €.

5. The customer may choose, if so wishes, to buy our merchandise under freight cost payable at destination or alternatively to organize the transportation by his own media.

6. When following customer’s request an order is placed subject to be delivered to an end consumer address an additional cost covering that kind of service will apply and the corresponding amount shall be included in our invoiced.

7. In the event of missing, lost, breakage or nicks occurred during transportation of our merchandise the customer must state the found facts in the packing list or bill of lading handed by the transporter. Otherwise the customer must notify it within 48 hours following the receipt of the merchandise by Fax or email.

8. Any claims filed for the above reasons must be duly supported and accompained with photos or images evidencing the defect.

9. Quality complaints or merchandise return shall not be accepted after10 days from the merchandise receipt’s date unless hidden vicious or defects might be found later which may be covered by our quality guaranty providing the complaint is properly documented.

10. Orders placed by phone must be confirmed in writing afterwards. The customer must always receive our order confirmation sent by fax or email. If the order confirmation is not received it should be understood that the order was not correctly placed.

11. The orders including special models, sizes or finish options must be clearly accepted and acknowledged by the customer signing or stamping our order confirmation. Said purchase orders shall be tailor made for the customer and accordingly they CAN NOT BE CANCELLED once we receive its confirmation.

12. Property rights apply. Invoiced products which are not fully paid remain the property of Angel Cerda S.L.

13. All prices are subject to V.A.T charge or equivalent tax applicable at the invoice date.

14. Angel Cerda S.L. shall request to obtain commercial information for all accounts by using credit insurance coverage with Credito y Caución Co.- . We shall only finance those accounts with granted risk coverage.h

15. Customers with no credit coverage would have to pay for their orders by bank transfer before its delivery.

16. Orders not reaching the minimum amount stablished in paragraph 3 would have to be paid upfront by bank transfer.

17. – Customers with granted insurance credit may use our financing facilities only in agreement with the payment terms previously agreed with Angel Cerda.

18. – When the payment choice is agreed through a draft payable in a bank appointed by the customer a SEPA form must be duly signed and stamped by the customer.

19. In the event of any of our invoices getting unpaid Angel Cerda will automatically block the customer’s account and shall adopt the necessary measures, either through the insurance company or through legal action, to obtain the payment due. Such payment incidents automatically generate an interna bank’s notice which is reported to the RAI which may badly affect the customer’s credit quality with third parties.

20. Orders to be delivered outside the territory of the E.U. shall be considered Ex-Factory. The customer will organize at his own risk the merchandise transportation and will have to take due care of all legal customs formalities to import the goods in the destination country. These orders must be paid either by bank transfer, immediately after its confirmation, or by opening a Letter of Credit through our Bank. Angel Cerdá shall provide Certificate of Origin as well as other legal documents required to clear customs and we shall demand to the customs agent incharged to obtain the export document EX1.

Certificate of Warranty

Angel Cerdá SL issues this document with its conditions as a quality warranty of the product and services it covers for a period of 24 months from the date of delivery. Such conditions are established without prejudice to the consumer’s rights in accordance with Royal Decree Law 1/2007 of 16th November.

This warranty does not cover defects caused by negligence, strikes or incorrect use or handling, by not having correctly applied the preservation and maintenance conditions or by materials subjected to wear and tear from normal use.

The following cases are expressly excluded from the warranty: damage caused by pets, damage caused by sharp materials, colouration of fabrics caused by rubbing against external textiles (clothing), damage caused by extreme heat or high temperature objects, damage caused by cleaning processes or inappropriate products.

In the face of any incidents that justify the use of his warranty, the options are repair or replacement of the item, or discount or resolution under the legally established terms.

This warranty shall be rendered invalid if:

  • The item that is the subject matter of this warranty, its identifying number or installation is handled or repaired, or if it is allocated a use other than that for which it was manufactured, without the knowledge and/or written authorization of the company.
  • The details of this warranty or of the purchase receipt are amended, altered or replaced.

In order to use the warranty, it is essential to present this document along with the purchase receipt.
